Wills, trusts, estate planning, and probate law is generally an area of law devoted to preparing for death or disability and to the management or distribution of a person’s property following death or disability. “Estate planning” generally covers the use of “wills” and “trusts” for the management and distribution of property after one’s death. “Probate” generally describes the court-administered management of a decedent’s estate or of a trust, guardianship, or conservatorship. This area of law also pertains to the preparation of advance medical directives (also known as “living wills”), medical powers of attorney, and financial powers of attorney.
